The Luggage Store LTD is committed to the highest standards of customer service and personal data protection, in compliance with the General Data Protection Regulation (RGPD) and the French Data Protection Act of 1978 as amended. The information collected is used exclusively for order processing and commercial relations.

ARTICLE 1 - SCOPE OF APPLICATION

1.1 These General Terms and Conditions of Sale (GTCS) govern the sale of products offered on the The Luggage Store LTD website (hereinafter the “WEBSITE”) to any CUSTOMER (hereinafter the “CUSTOMER”), whether a consumer or a professional. By placing an order, the CUSTOMER unconditionally accepts the terms and conditions in effect on the date of the order.

1.2 Any deviation from these GTC shall be valid only if agreed to in writing between the CUSTOMER and The Luggage Store LTD.

1.3 The Luggage Store LTD reserves the right to modify these GTC at any time. The applicable version is the one in effect at the time the order is validated by the CUSTOMER.

1.4 These GTC are accessible at all times on the SITE and are deemed accepted by the CUSTOMER upon validation of the order.

ARTICLE 2 - OFFER AND PRODUCTS

2.1 The Luggage Store LTD presents on the SITE a range of firewood products (hereinafter “Products”). The description, characteristics and prices of the Products are provided for information purposes only and are subject to change without notice.

2.2 The Products are presented in such a way as to enable the CLIENT to become acquainted with their essential characteristics. However, the photographs and illustrations of the products are for information purposes only and shall not incur the liability of The Luggage Store LTD.

2.3 In the event that the sale of a product is modified or interrupted, The Luggage Store LTD will inform the CUSTOMER and offer an equivalent solution or a refund.

ARTICLE 3 - PRICES AND TERMS OF PAYMENT

3.1 Product prices are quoted in euros, inclusive of all taxes, including the VAT applicable on the day the order is placed. Delivery charges are specified separately and added to the order total. The Luggage Store LTD reserves the right to modify its prices at any time, but products will be invoiced at the rate in effect at the time the order is validated.

3.2 For orders outside the European Union, prices are calculated exclusive of taxes. The CLIENT is responsible for any taxes and customs duties related to the importation of products into its country.

3.3 The Luggage Store LTD accepts payment by credit card (Visa, Mastercard, Carte Bleue), bank transfer and other secure online payment methods. Payment is due immediately upon placing an order. The Luggage Store LTD uses advanced security protocols to protect payment information.

3.4 In the event of non-payment or insufficient payment, The Luggage Store LTD reserves the right to suspend the order and/or charge late payment fees. A late payment interest of three times the legal interest rate will be applied, as well as a fixed indemnity for collection costs, in accordance with Article L.441-6 of the French Commercial Code.

ARTICLE 4 - ORDERING

4.1 The CLIENT may place an order directly on the SITE by following the order steps. The order is considered firm and final upon confirmation of payment via the secure payment gateway.

4.2 The Luggage Store LTD reserves the right to refuse an order in the event of an ongoing dispute, a risk of fraud, or if the order is deemed abnormal (excessive quantity, product not in compliance with the intended use, etc.).

4.3 The CLIENT will receive an order confirmation email containing a summary of the products, the total amount and the order number. In the event of an error in the information provided by the CLIENT, The Luggage Store LTD shall not be held liable for the consequences of such an error.

ARTICLE 5 - DELIVERY

5.1 The Luggage Store LTD undertakes to make deliveries within the deadlines communicated at the time of order confirmation, except in the event of force majeure (strikes, bad weather, supply problems, etc.). Delivery times are given as an indication, and The Luggage Store LTD cannot be held responsible for delays in delivery for which it is not responsible.

5.2 Delivery charges are calculated based on the weight and destination of the products and are indicated before the order is validated. The CLIENT may choose from among the available delivery options (standard, express, etc.).

5.3 Upon delivery, the CLIENT must check the condition of the products. If a product is damaged, the CUSTOMER must express his/her reservations on the delivery slip and contact The Luggage Store LTD within 48 hours of receipt.

5.4 The transfer of risk and ownership of the products is transferred to the CUSTOMER upon delivery. However, The Luggage Store LTD retains ownership of the products until the order has been paid in full.

ARTICLE 6 - RETURNS AND RIGHT OF WITHDRAWAL

6.1 In accordance with Article L.221-18 of the French Consumer Code, the CLIENT has a period of 14 calendar days from receipt of the products to exercise its right of withdrawal without having to justify its decision or pay any penalties.

6.2 To exercise this right, the CUSTOMER must notify The Luggage Store LTD of its decision to cancel in writing, using the cancellation form provided on the SITE or by any other written means.

6.3 Products must be returned in their original, unused and complete condition. Return shipping costs shall be borne by the CUSTOMER, except in the event of defective products or error on the part of The Luggage Store LTD.

6.4 The Luggage Store LTD will reimburse the CUSTOMER within 14 days of receiving the returned products and verifying their condition.

ARTICLE 7 – GARANTIES ET RESPONSABILITÉ

7.1 Tous les produits bénéficient de la garantie légale de conformité (article L.217-4 et suivants du Code de la consommation) et de la garantie contre les vices cachés (article 1641 et suivants du Code civil). En cas de défaut de conformité ou de vice caché, le CLIENT peut demander le remplacement du produit ou son remboursement.

7.2 La responsabilité de The Luggage Store LTD ne saurait être engagée en cas de mauvaise utilisation des produits, de négligence ou de défaut d’entretien par le CLIENT.

7.3 The Luggage Store LTD n’est pas responsable des dommages indirects (perte de revenus, dommages immatériels, perte de données) qui pourraient résulter de l’achat ou de l’utilisation des produits.

ARTICLE 8 - INTELLECTUAL PROPERTY

8.1 All content on the SITE (text, images, logos, trademarks, etc.) is protected by intellectual property rights and is the exclusive property of The Luggage Store LTD or its partners. Any reproduction, distribution or use, even partial, is prohibited without the prior consent of The Luggage Store LTD.

ARTICLE 10 - APPLICABLE LAW AND JURISDICTION

10.1 These GCS are governed by French law. In the event of a dispute, the CLIENT may refer the matter to the competent court in accordance with the rules of jurisdiction set out in the French Code of Civil Procedure.

ARTICLE 11 - FORCE MAJEURE

11.1 The Luggage Store LTD shall not be held liable for the total or partial non-performance of its obligations in the event of force majeure. Events such as war, strikes, epidemics, natural disasters, fires, communication network failures, supply chain interruptions or any other event beyond the reasonable control of The Luggage Store LTD shall be considered as force majeure.

11.2 In the event of such an event, The Luggage Store LTD's obligations shall be suspended for the duration of the impediment. The Luggage Store LTD shall inform the CUSTOMER of the occurrence of the force majeure event as soon as possible.

ARTICLE 12 - MODIFICATION OF TERMS AND CONDITIONS

12.1 The Luggage Store LTD reserves the right to modify these GTC at any time, without prior notice. Such modifications shall be applicable as soon as they are published on the SITE.

12.2 The modified GTC shall not apply to orders already validated by the CUSTOMER prior to their posting online. The CLIENT will be informed of the modifications via the SITE, and these modifications will be deemed accepted by the CLIENT when placing any new order.

ARTICLE 13 - CUSTOMER SERVICE AND COMPLAINTS

13.2 The Luggage Store LTD will use its best efforts to promptly resolve any claim. In the event of an unresolved dispute, the CUSTOMER may refer the matter to the competent consumer mediator to attempt to reach an amicable settlement.

ARTICLE 14 - ACCEPTANCE OF CONDITIONS

14.1 The placing of an order implies the CUSTOMER's full and unreserved acceptance of these terms and conditions. This acceptance is evidenced by ticking the box “I have read and accept the terms and conditions of sale” when validating the order.

ARTICLE 15 - SEVERABILITY

15.1 If any of the provisions of these GTC are deemed invalid or unenforceable by a competent judicial authority, the other provisions shall remain in force and continue to have effect.

ARTICLE 16 - Applicable law and disputes

16.1 These GCS are governed by French law. In the event of a dispute, the parties shall endeavor to resolve their differences amicably. In the absence of an amicable agreement, the competent courts shall be those of the jurisdiction where the CLIENT is domiciled or where The Luggage Store LTD has its registered office, unless an imperative legal provision provides otherwise.

ARTICLE 17 - PERSONAL DATA

17.1 The Luggage Store LTD collects, uses and protects the CLIENTS' personal data in accordance with current legislation on the protection of personal data. The privacy policy, which is a separate document that can be consulted on the SITE, details the terms and conditions for the collection, use, retention and sharing of personal data.
