The Luggage Store LTD is committed to respecting the highest standards in customer service and personal data protection, in accordance with the General data protection regulation (GDPR) and the amended Data Protection Act of 1978. The information collected is used exclusively as part of the processing of orders and the commercial relationship.
ARTICLE 1 - SCOPE OF APPLICATION
1.1 These General Terms and Conditions of Sale (GTC) govern the sale of products offered on the The Luggage Store LTD website (hereinafter the "SITE") to any CUSTOMER (hereinafter "the CUSTOMER"), whether consumer or professional. By placing an order, the CUSTOMER unreservedly accepts the GTC in force on the date of the order. 1.2 Any derogation from these GTC is valid only if it has been agreed in writing between the CUSTOMER and The Luggage Store LTD. 1.3 The Luggage Store LTD reserves the right to modify these GTC at any time. The applicable version is the one in force at the time of validation of the order by the CUSTOMER. 1.4 These GTC are accessible at any time on the SITE and are considered accepted by the CUSTOMER during the validation of his order.
ARTICLE 2 - OFFER AND PRODUCTS
2.1 The Luggage Store LTD presents on the SITE a range of products relating to firewood (hereinafter "Products"). The description, characteristics and prices of the products are provided for information purposes only and are subject to change without notice. 2.2 The products are presented in such a way as to allow the CUSTOMER to become aware of their essential characteristics. However, the photographs and illustrations of the products are only indicative and cannot engage the responsibility of The Luggage Store LTD. 2.3 In the event of modification or interruption of the sale of a product, The Luggage Store LTD will inform the CUSTOMER and offer an equivalent solution or a refund.
ARTICLE 3 - PRICES AND PAYMENT TERMS
3.1 The prices of the products are indicated in euros, all taxes included (TTC), including the VAT applicable on the day of the order. The delivery costs are specified separately and added to the total of the order. The Luggage Store LTD reserves the right to modify its prices at any time, but the products will be invoiced at the rate in force at the time of validation of the order. 3.2 For any order outside the European Union, the prices indicated are calculated excluding taxes. The CUSTOMER is responsible for any taxes and customs fees related to the importation of products into his country. 3.3 The Luggage Store LTD accepts payments by credit card (Visa, Mastercard, Carte Bleue), bank transfer and other secure online payment methods. Payment is due immediately when ordering. The Luggage Store LTD uses advanced security protocols to protect payment information. 3.4 In the event of non-payment or insufficient payment, The Luggage Store LTD reserves the right to suspend the order and/or charge late fees. A late payment interest of three times the legal interest rate will be applied, as well as a fixed compensation for recovery costs, in accordance with Article L.441-6 of the Commercial Code.
ARTICLE 4 - ORDER
4.1 The CUSTOMER can place an order directly on the SITE by following the order steps. The order is considered firm and definitive upon confirmation of payment via the secure payment gateway. 4.2 The Luggage Store LTD reserves the right to refuse an order in the event of an ongoing dispute, the risk of fraud, or if the order is deemed abnormal (excessive quantity, product not in accordance with the intended use, etc.). 4.3 The CUSTOMER receives an order confirmation email including the summary of the products, the total amount and the order number. In the event of an error in the information provided by the CUSTOMER, The Luggage Store LTD cannot be held responsible for the consequences of such an error.
ARTICLE 5 - DELIVERY
5.1 The Luggage Store LTD undertakes to make deliveries within the deadlines communicated when confirming the order, except in cases of force majeure (strikes, bad weather, supply problems, etc.). The delivery times are given as an indication, and The Luggage Store LTD cannot be held responsible for delivery delays that do not fall under its responsibility. 5.2 The delivery costs are calculated according to the weight and destination of the products and are indicated before the validation of the order. The CUSTOMER can choose from the available delivery options (standard, express, etc.). 5.3 Upon delivery, the CUSTOMER must check the condition of the products. If a product is damaged, the CUSTOMER must indicate his reservations on the delivery note and contact The Luggage Store LTD within 48 hours of receipt. 5.4 The transfer of risk and ownership of the products are transferred to the CUSTOMER upon delivery. However, The Luggage Store LTD retains ownership of the products until full payment of the order.
ARTICLE 6 - RETURNS AND RIGHT OF WITHDRAWAL
6.1 In accordance with Article L.221-18 of the Consumer Code, the CUSTOMER has a period of 14 calendar days from receipt of the products to exercise his right of withdrawal without having to justify reasons or pay penalties. 6.2 To exercise this right, the CUSTOMER must notify The Luggage Store LTD of his decision to withdraw in writing, using the withdrawal form provided on the SITE or by any other written means. 6.3 The products must be returned in their original, unused and complete condition. The return costs are the responsibility of the CUSTOMER, except in the case of defective products or error on the part of The Luggage Store LTD. 6.4 The Luggage Store LTD will refund the CUSTOMER within 14 days of receipt of the returned products and checking their condition.
ARTICLE 7 - GUARANTEES AND LIABILITY
7.1 All products benefit from the legal guarantee of conformity (Article L.217-4 and following of the Consumer Code) and the guarantee against hidden defects (article 1641 and following of the Civil Code). In case of lack of conformity or hidden defect, the CUSTOMER may request the replacement of the product or its refund. 7.2 The Luggage Store LTD cannot be held liable in the event of misuse of the products, negligence or lack of maintenance by the CUSTOMER. 7.3 The Luggage Store LTD is not responsible for any indirect damage (loss of income, intangible damage, loss of data) that may result from the purchase or use of the products.
ARTICLE 8 - INTELLECTUAL PROPERTY
8.1 All the contents present on the SITE (texts, images, logos, brands, etc.) are protected by intellectual property rights and are the exclusive property of The Luggage Store LTD or its partners. Any reproduction, distribution or exploitation, even partial, is prohibited without the prior consent of The Luggage Store LTD.
ARTICLE 9 - PERSONAL DATA
9.1 The Luggage Store LTD undertakes to protect the CUSTOMER's personal data in accordance with the privacy policy available on the SITE. The data collected is necessary for the processing of orders, the management of the customer relationship and the personalization of the services. 9.2 The CUSTOMER has the right to access, rectify, oppose and request the deletion of his personal data by contacting The Luggage Store LTD by email at [email protected].
ARTICLE 10 - APPLICABLE LAW AND COMPETENT JURISDICTION
10.1 These GTC are governed by French law. In the event of a dispute, the CUSTOMER may refer the matter to the competent court according to the rules of jurisdiction provided for by the Code of Civil Procedure.
ARTICLE 11 - FORCE MAJEURE
11.1 The Luggage Store LTD cannot be held responsible for the total or partial non-performance of its obligations in the event of force majeure. In particular, force majeure is considered to be events such as wars, strikes, epidemics, natural disasters, fires, communication network failures, supply chain interruptions, or any other event beyond the reasonable control of The Luggage Store LTD. 11.2 In the event of such an event occurring, The Luggage Store LTD's obligations will be suspended for the duration of the impediment. The Luggage Store LTD will inform the CUSTOMER of the occurrence of the force majeure event as soon as possible.
ARTICLE 12 - MODIFICATION OF THE GTC
12.1 The Luggage Store LTD reserves the right to modify these GTC at any time, without prior notice. The modifications will be applicable as soon as they are published on the SITE. 12.2 The modified GTC will not apply to orders already validated by the CUSTOMER before they are posted online. The CUSTOMER will be informed of the changes via the SITE, and these changes will be deemed accepted by the CUSTOMER when placing any new order. ARTICLE 14 - ACCEPTANCE OF THE CONDITIONS
14.1 Placing an order implies full and unreserved acceptance by the CUSTOMER of these GTC. This acceptance is materialized by checking the box "I have read and accept the general conditions of sale" when validating the order.
ARTICLE 15 - SEVERABILITY
15.1 If one of the provisions of these GTC is deemed invalid or unenforceable by a competent judicial authority, the other provisions will remain in force and will continue to have their effects.
ARTICLE 16 - Applicable Law and Disputes
16.1 These GTC are governed by French law. In the event of a dispute, the parties will endeavour to resolve their differences amicably. In the absence of an amicable agreement, the competent courts will be those of the jurisdiction where the CUSTOMER is domiciled or the registered office of The Luggage Store LTD, unless an imperative legal provision provides otherwise.
ARTICLE 17 - PERSONAL DATA
17.1 The Luggage Store LTD collects, uses and protects CUSTOMERS' personal data in accordance with current legislation on the protection of personal data. The Privacy policy, which is a separate document and can be consulted on the SITE, details the methods of collection, use, storage and sharing of personal data.
